3. Your Account

  • Creating an account is required for placing orders and accessing certain features.

  • Notify us immediately if you suspect unauthorized use.

4. User Content

“User Content” includes reviews, photos, ratings, comments, and any material submitted by you on the Platform.

By submitting User Content, you grant Apnaeats a worldwide, royalty-free, transferable, sublicensable license to use, display, modify, distribute, and create derivative works from your content.

You agree that:

  • Your content is lawful and does not violate rights.

  • Apnaeats may remove or modify content that violates policies.

  • You are solely responsible for your posted content.

5. Ownership & Platform Content

  • All Platform content—text, images, menus, graphics, design—is owned by Apnaeats or its partners.

  • You are granted a limited, personal, non-commercial license to use the Platform.

  • You may not reproduce, copy, sell, scrape, or publicly display any Platform content without permission.

6. Prohibited Activities

When using Apnaeats, you agree not to:

  • Post unlawful, abusive, misleading, or harmful content.

  • Use bots, scrapers, or automated tools to access the Platform.

  • Collect information about other users.

  • Tamper with, disrupt, or reverse-engineer the Platform.

  • Impersonate others or misrepresent your identity.

Violation may result in account suspension or termination.

7. Food Orders & Restaurant Responsibility

  • Apnaeats is an intermediary that connects customers with restaurants.

  • When you place an order, Apnaeats submits it to the chosen restaurant on your behalf.

  • Restaurants are solely responsible for:

    • Food preparation

    • Quality and hygiene

    • Packaging

    • Menu accuracy

Apnaeats is not responsible for:

  • Incorrect, missing, or poor-quality food

  • Delivery delays

  • Allergic reactions or food safety issues

  • Restaurant service quality

Incorrect or Missing Items

Refunds/replacements depend on the restaurant’s policy. Apnaeats will assist but cannot guarantee compensation.

Delivery Information

You must provide accurate address and contact details. Wrong information may lead to order failure without refund.

Resale Restrictions

Food purchased via Apnaeats cannot be resold.

8. Pricing, Fees & Payments

  • Restaurant prices shown on Apnaeats may change at the time of order.

  • Additional charges such as delivery fees, packaging, and taxes may apply.

  • Discounts, coupons, and membership benefits apply only to eligible items.

  • Compensation for late delivery (if offered) may be provided as coupons or credits.

Payments must be made through approved payment methods.

9. Table Reservations (If Applicable)

If Apnaeats provides reservation functionality:

  • Some reservations may require a fee.

  • Refund eligibility depends on the restaurant’s cancellation window.

  • Late arrival may result in cancellation without refund.

10. Third-Party Advertisements & Links

  • Apnaeats may display ads from restaurants or third-party advertisers.

  • Deals or interactions with advertisers are solely between you and the advertiser.

  • Apnaeats is not responsible for external websites or services.

11. Disclaimers & Limitation of Liability

To the maximum extent allowed by law:

  • Apnaeats is provided “as is” and “as available.”

  • We do not guarantee uninterrupted services, accurate information, or error-free performance.

Apnaeats is not liable for:

  • Loss of profits, data, reputation, or indirect damages

  • Issues caused by restaurants or delivery partners

  • Service interruptions, network failures, or technical errors

  • Any claims arising from User Content

You agree to indemnify Apnaeats against claims arising from unlawful usage or content posted by you.

12. Termination of Access

Apnaeats may suspend or terminate:

  • Accounts violating these Terms

  • Users suspected of fraudulent activity

  • Access as required by law or security concerns

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India.
Disputes will be subject to the exclusive jurisdiction of courts located in your city of residence or Apnaeats’ registered jurisdiction, unless required otherwise by law
